Programme Synopsis

This seminar by STEP Singapore will connect the dots of incapacity issues in relation to assets management and the interactions with family trust. In this session, we will learn about the following:  
  • Understanding the different shades of mental incapacity. 
  • Best practices that trust and estate practitioners should undertake to prepare themselves when working with trust relevant parties who may lack mental capacity in future. 
  • What are the merits of working with a Professional Deputy or Professional Donee representing a settlor or a beneficiary? 
  • What processes are put in place for vulnerable clients by trust companies?

Lay Lian graduated from the National University of Singapore in 1985 and is called to the bar in 1986. She is listed as Preeminent family lawyer in Leading Singapore Family for Divorce Lawyers (2015) by Doyles Family Lawyer Guide and Leading Lawyer in Benchmark Litigation Asia-Pacific 2019 and 2020 editions for being a Dispute Resolution Star for Family and Matrimonial Practice and Private Clients. She has been at the firm since 1986 and she has dealt with a diversity of cases ranging from banking, insurance, trademarks, land law, employment disputes to commercial and family law. 

With three decades of experience in a range of cases, Lay Lian currently specialises in family law, adoption, commercial litigation and trust. She has successfully dealt with complex family cases involving cross-jurisdiction issues over assets, maintenance and children. She also acts in contentious probate, trusts and succession disputes.

As one of the first professionals registered under the Professional Deputy and Donee Scheme in 2018, Seow Ling is deeply passionate and committed to supporting individuals without a reliable social network. An Accredited Mediator and Certified Family Mediator with the Singapore Mediation Centre, she brings her expertise in conflict resolution to help families navigate disputes with empathy and facilitate communication.

Keith Ng is Director at Harneys Fiduciary. He brings more than 20 years of experience in administering complex trust structures across multiple jurisdictions, with a strong emphasis on Singapore.

Keith began his career in 2004 and has since developed a strong reputation for his expertise in cross-border trust solutions, restructuring matters, and contentious trust issues. He has worked extensively with Asian private clients and has a nuanced understanding of the cultural values and dynamics that shape Asian family wealth and succession planning.

He holds a Bachelor of Commerce from the University of Queensland, Australia, and professional qualifications including the STEP Diploma in International Trust Management and an Advanced Certificate in Trust Services from the Wealth Management Institute in Singapore.
