Programme Synopsis

This session by STEP Singapore will explore practical compliance challenges for trustees under CRS 2.0 and CARF in complex trust structures. In this session, we will learn about the following:
  • How should trustees operationally handle conflicting tax residency claims for trusts or underlying entities under CRS 2.0? (Focus on documentation, decision-making, and audit defensibility.)
  • What practical steps should trust companies take to identify and manage CRS exposure arising from lending and collateral arrangements within trust structures?
  • Given CARF, how far does a trustee’s responsibility extend when a trust holds crypto assets indirectly through funds or SPVs?

Mercy Joseph is a Managing Director with Alvarez & Marsal Tax in Singapore. She leads the operational tax team and specializes in tax reporting regimes, such as the Foreign Account Tax Compliance Act (FATCA), the Common Reporting Standard (CRS), and the Qualified Intermediary (QI) agreement.

Ms. Joseph has more than 18 years of tax experience, including 10 years in operational taxes. She has worked with banks, funds, trustees, brokers, insurance companies, family offices, digital asset service providers, and multinational companies to set up and elevate their FATCA/CRS programs. She has led FATCA/CRS implementation programs for various types of financial institutions; notably, she has uplifted banks’ FATCA/CRS target operating model, provided funds and family offices with managed services, and conducted controversy management and health checks for a range of banks, insurance, and asset management groups.

Prior to joining A&M, Ms. Joseph spent over 12 years with EY in Singapore, where she most recently served as a Tax Partner leading FATCA, CRS, and QI projects for clients in the Association of Southeast Asian Nations (ASEAN).

Ms. Joseph earned a bachelor’s degree in commerce from the University of Mumbai and is a Chartered Accountant with the Institute of Chartered Accountants of India (ICAI).

Dr. Genevieve Brunner is a seasoned compliance professional with over 15 years of expertise in Financial Crime Compliance (FCC) and Regulatory Compliance within the banking and trust sectors. She is the Head of Compliance and MLRO for BOS Trustee Limited and has played a pivotal role in designing and implementing the compliance framework (including higher risk assets and complex structures), enhancing due diligence processes, and fostering a strong culture of compliance. With a Doctorate in Law from the University of St. Gallen (Switzerland) and an LL.M. from NUS, Genevieve brings legal and regulatory insights to complex compliance challenges. She is a full qualified member of the Society of Trust and Estate Practitioners (STEP).
